Demoted when I came back from maternity leave

Akinyi, Kisumu · Banking

I returned from three months of maternity leave to find my role given to a colleague and myself moved to a junior desk with "the same pay for now". HR said it was restructuring.

How it ended

I filed at the ELRC. The court found the demotion discriminatory and awarded compensation plus reinstatement to an equivalent role.

Legal redress options

Section 29 guarantees return to the same or a suitable job after maternity leave, and s.5 bars discrimination on pregnancy. Write to HR to create a record, then approach the Labour Officer or ELRC.
